Unsolicited Submissions Note

A Note about Unsolicited Submissions:  

To avoid the possibility of future misunderstandings when products and projects developed by or for McCormick & Company, Inc., its subsidiaries, affiliates, or related entities (“McCormick”), or by their employees and contractors (collectively, the “McCormick Entities”) may have similarities with products and projects proposed or developed by others, McCormick does not accept, review or consider any unsolicited ideas, works, materials, proposals, suggestions, artwork, content or similar materials, including for advertising campaigns, promotions, products, services, technologies, product enhancements or improvements, processes, marketing strategies, product names, content or creative materials in any form or format (all of the foregoing “Unsolicited Submissions”). Please do not send or provide any Unsolicited Submissions in any form to McCormick Entities.  

If, despite our request that you not send us Unsolicited Submissions, you still submit them, then regardless of what any correspondence forwarding any Unsolicited Submission says, you expressly acknowledge and agree that: (1) there is no obligation for McCormick to review your Unsolicited Submission(s), to keep them or return them to you (2) there is no obligation to treat your Unsolicited Submission(s) confidential or proprietary, (3) your Unsolicited Submission(s) and their contents along with all related intellectual property comprising or contained in the Unsolicited Submission(s) along with all worldwide rights therein (including all intellectual property rights therein) will automatically become the exclusive property of McCormick, without any compensation to you, to the full extent allowed by applicable law; (4) you waive, to the fullest extent allowed by applicable law all moral rights and other similar rights of authorship in the Unsolicited Submission(s) and all content therein, (5) McCormick may reproduce, use, advertise, display, make, have made or otherwise exploit in any manner (“Use”) Unsolicited Submission(s) and their contents, in whole or in part, in any way, for any purpose, on an unrestricted basis, without providing any compensation or acknowledgement to you (6) the McCormick Entities shall have no liability to you whatsoever regarding any Unsolicited Submission(s), the content therefor of the Use thereof by the McCormick Entities.   

Feedback and other content submitted to McCormick will be reviewed and handled pursuant to the Website Terms of Use; provided, however, that in the event of a conflict between this Note about Unsolicited Submissions and the Website Terms of Use, this Note about Unsolicited Submissions will prevail.
